$6.2 Million Settlement Reached in DUI Case
A woman who owned a day care center was conducting a business meeting with a local business owner regarding her attempt to purchase another day care center. After work, they met at a local bar and discussed terms of the financial arrangement and the profitability of the new company.
On her way home, traveling at a speed of approximately 58 miles per hour, she crossed the centerline and hit two vehicles. She was legally drunk at the time of the incident.
Nine people were injured in a van. The father driving the van was pinned behind the steering wheel for approximately one hour until rescue personnel could execute him from the van. The mother had a serious arm injury that required extensive surgery. The other children were only bumped and bruised except for an 8-year-old girl who was flown to St. Joseph’s hospital in Phoenix where they specialize in dealing with brain injuries.
All the children, including the girl flown to Phoenix, made a very good recovery, as did their parents. A settlement was reached for $6.2 million.
$1.08 Million Settlement for Van Accident
A 19-year-old man, driving his brother’s car, with his brother and sister-in-law as passengers was struck by a 15-passenger van that ran a stop sign.
He sustained a serious injury to his wrist, which was his dominant hand, and would require considerable surgery to either fuse his wrist, leaving him with no motion, or have to have a wrist joint replacement.
Those particular joints do not last more than 10 years so he will require general subsequent surgeries. The sister-in-law sustained significant pelvic and leg injuries. The case settled for $1,080,000.00.
Fatal Collision Settlement for $1 Million
A 4-year-old boy, with his four brothers and sisters, was crossing a street in a crosswalk going from a park to the sidewalk on the opposite side of the roadway. A pool man, driving a company pickup truck, was looking for next house where he needed to service a pool.
He started to turn to the right on a street before the spot where the children were crossing. He then noticed that he was turning on the wrong street, so he turned back to the left to continue going straight. He accelerated and at that point, the children had crossed the roadway except for the 4-year-old boy who was struck and killed.
It was clearly established that the driver was in the scope and course of his employment and the company was liable for the accident. The case settled for the $1,000,000.00 policy limits.
$1.55 Million Settlement for a Wrongful Death Caused by 18-wheeler
A husband and wife, driving their pickup truck back home, stopped at a red light. Suddenly and without warning, an 18-wheeler crashed into their pickup. The husband was killed and the wife suffered injuries. A claim for her injuries and the wrongful death of her husband settled for a total of $1,550,000.
$825,000.00 Settlement for a Construction Truck Accident
On February 13, 2007, a husband and wife were returning home after eating at a local restaurant. As they were driving, an employee of a local packing company, who was driving a company truck, suddenly and without warning, turned left in front of them, causing a serious impact to occur.
The wife was seriously injured. She had numerous broken ribs, fractures in both of her bones in the right leg, an open fracture of the right ankle, and fractures of both bones in the right arm and a fracture of the right thumb.
These injuries resulted in multiple surgical procedures. On March 12, 2008, the case settled for the amount of $825,000.
